Question about Prepaid Service plan YAMAHA SUZUKI OF TEXAS

OK,  I bought my bike  from an individual  who purchased it   from this dealership.   He  bought an  extended warranty and  a  prepaid  service contract  good  for  6  regular  scheduled  services.    The seller  had  only  used  2  of the  6  services.  His paperwork says  the  warranty  is  for  36 months,  but  has  no  timeframe  or  expiration listed on the paperwork  for  the  services.  It is  tranferable  to the  new owner  with a  $50  transfer fee.  So  we  called the  finance  manager  who is  in  charge of  this  and  she  says  the  service plan   is  expired  too.    Nothing  in the  documentation indicates any  requirement  on time or  mileage  for the  services  to  be  performed.      Attorney  says  I  could probably  force them to  honor  it, but it  will cost  $$$ and  to tell the  truth,  at this  point  I'd  rather them not  work  on my  bike.  I'd  be  happy  if  they  just  gave  me  the materials  for the  services to be  performed.

I suppose I am  just  looking  for  confirmation,  is  it  worth  going  after them  for  something or not?        I've  had  some  bad  service  from this  dealer in the past  as  well,  including  being told to  wait  over an hour  and  a  half  when I went  there  for a state safety inspection on another  bike  only  to  be  told  at the  end  of  the  time  that  their  inspector  had the  day off.

I think I would avoid going to that dealer if at all possible.

i would just let it go, theres not really much the dealer can do that you cant except for major repairs and then you'll still have to worry about some greasy squid messin' up your bike, i bought all the recall parts for my bike and had an independant shop do the work (and payed for it out of my pocket) because the tech there is top notch, i cant say that for any of the dealers around here, as a matter of fact i'm dealing with an idiot yamaha repair tech who is working on my 4 stroke outboard and i swear that when i get that boat out of his shop it will NEVER go backSuper Angry

I would make a BBB complaint. It is not simply a promise or word of mouth. It is not even a 30,000 or 3 months issue. It is a pre-paid contract for regular maintenance services. The contract was also transferred and fees paid.

It wont' cost anything to make the  complaint online with the BBB that investigates your area. I would ask for the remaining balance in return since they refused to follow a contract and let it proceed from there.

Once you win, I would take my bike elsewhere anyways since they will probably pee in your tank.

Gone. Too much editing. Baby about it, yes. I would like to have real discussions. If I want to have things not reported/discussed\deleted I would watch main stream media. This was one of my alternatives. Later all.

Ya, there's also Ripoff report.  While BBB isn't really anything enforceable, I've seen such a threat work.  For example, my friend brought a car into Midas for something and then he got charged extra for work that was not approved (only like $35) and I over heard the dealer say, "But it was black you needed it changed."  My friend was like,"but I didn't say to do it...I don't want to report you to the Better Buisness Bureau..." and the mechanic let it go.

Does the dealer have proof that it's expired?  Just ask for a print out of the service contract from them.

Could the individual you bought it from be lying?  If not, I would do a small claims court because someone has to stand up to those dealers.

The finance manager is just a middle person maybe.  Talk to someone higher.

i have also had some bad sevice from that dealer's service center and would recommend not taking it there. But if you decide to still get your service there, go ahead and call the generalmanager and let him know what's going on.

that is how i finally resolved my issues.

call and *** to high heavan to get the parts/materials for the services. plugs, oil, filters etc  and do it your self.  if they dont comply report them to BBB  i cant stand companies taking advantage of the little guy

If you are not part of the solution then you are part of the precipitate

Just tell everyone and everyone you meet about this stealer and do the BBB thing.. dont threaten, just do it.. The stealer will have a chance to respond and then you let the BBB know if they took care of the issue.. I have been dealing with the jerk-off where I bought my brand new 07 with 05 wheels on it since July 10th.  BBB, State attonrney general, state police, still nothing, but I'm gonna keep plugging away.. The stealer just figures you wont want to take the time to fight it..Good luck!!

If you think nobody cares.....try missing a couple payments!

The way these things work is the service contract is part of the extended warranty which has a 3 year term.  That's called a dealer service warranty and they are sold by Yamaha and by others, including individual dealers in some cases.  If you ride a lot they are worth something.  If you don't ride a lot then they expire before you get any benefit.  Let it go you you can't win.  Well, it sounds like you CAN win just by avoiding that dealer!

This dealership sells maintenance agreements a la carte ,  can be with or without an  extended warranty.   It is  a maintenance agreement.  They will sell one  on a  bike not  purchased  from them as well.

I have  some complaints going now,  appreciate the  feedback.
